1. Agreement to these Terms
These Terms of Service ("Terms") are an agreement between you and The I AM Reset, operated by Audra Miller in Ohio, United States ("The I AM Reset," "we," "us," or "our"). They govern your access to theiamreset.com, related content, booking experiences, and coaching or educational services we offer (collectively, the "Services").
By accessing the website, booking a consultation, purchasing a Service, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to use or purchase the Services. By doing so, you represent that you meet these requirements and that the information you provide is accurate and complete.
3. Coaching and educational services
The I AM Reset provides coaching, accountability, education, and personal-development support. Services may address mindset, faith, identity, purpose, health and fitness habits, relationships, finances, or other life goals. The specific scope, format, duration, and deliverables of a paid Service are those described at the time of purchase or in a separate written agreement.
Coaching is a collaborative process. You are responsible for your choices, participation, effort, and implementation. We may recommend that you seek support from an appropriately licensed professional when an issue falls outside the scope of coaching.
No professional advice or emergency services
The Services are not medical care, mental-health treatment, therapy, nutritional or dietetic treatment, legal advice, tax advice, investment advice, or another licensed professional service. They are not a substitute for diagnosis or treatment by a qualified professional and are not intended for emergencies.
Consult a physician or other qualified provider before beginning or changing an exercise, nutrition, wellness, or health-related program, particularly if you have a medical condition, injury, take medication, are pregnant, or have concerns about your ability to participate. If you believe you may be experiencing an emergency, contact emergency services immediately.
Faith-based content
Some Services and content may include Christian, biblical, or faith-based perspectives. This content is offered as part of our coaching approach and is not a replacement for pastoral, medical, or mental-health care.
4. No guarantee of results
Individual results vary. We do not promise or guarantee any particular physical, financial, personal, relational, spiritual, or other outcome. Testimonials and examples describe individual experiences and are not promises that you will achieve the same or similar results. Your results depend on many factors outside our control, including your circumstances, decisions, consistency, health, and effort.
5. Fees, payment, and refunds
Prices, payment schedules, and included Services are disclosed before purchase. You agree to provide accurate billing information and authorize the charges you approve. When a third-party payment processor is used, its terms and privacy practices also apply.
Except where required by law, all sales are final and non-refundable. A failure to attend, participate in, or complete a purchased Service does not create a right to a refund. Any written scheduling, cancellation, expiration, or rescheduling terms presented for a specific Service at booking or purchase are incorporated into these Terms.
6. Your responsibilities and acceptable use
You agree that you will not:
- Use the Services for an unlawful, fraudulent, abusive, or harmful purpose.
- Harass, threaten, impersonate, or violate the rights or privacy of another person.
- Interfere with the website, attempt unauthorized access, or introduce malicious code.
- Copy, distribute, sell, publish, or commercially exploit our materials without permission.
- Record a private coaching session without the advance consent of everyone involved.
- Share access to paid materials with anyone who has not purchased or been granted access.
We may limit, suspend, or end access to the Services for conduct that violates these Terms, threatens safety, disrupts a coaching environment, or infringes another person's rights.
7. Intellectual property
The website and Services, including their text, graphics, branding, exercises, frameworks, worksheets, videos, recordings, downloads, and other materials, are owned by or licensed to The I AM Reset and are protected by applicable intellectual-property laws.
When you lawfully purchase or receive materials, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use them for your own noncommercial purposes. No ownership rights are transferred to you.
8. Feedback, stories, and testimonials
You retain ownership of content you submit to us. We will not publicly use your name, image, testimonial, or personal story for marketing without permission. If you separately authorize a testimonial or other content, you grant us the rights described in that authorization. You may contact us with questions about future use of an authorized testimonial.
9. Third-party services and links
The website may link to services operated by others, including Calendly for scheduling. We do not control third-party services and are not responsible for their availability, security, content, or practices. Your use of those services is governed by their own terms and privacy policies.
10. Disclaimers
To the fullest extent permitted by law, the website, content, and Services are provided "as is" and "as available." We disclaim warranties that are not expressly stated in a written agreement, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the website will always be uninterrupted, error-free, or secure.
Some laws do not allow certain warranty exclusions. In that case, the exclusions apply only to the extent permitted by law.
11. Limitation of liability
To the fullest extent permitted by law, The I AM Reset and Audra Miller will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, opportunities, or goodwill, arising from or related to the Services.
To the fullest extent permitted by law, our total liability for all claims arising from or related to a paid Service will not exceed the amount you paid us for the specific Service giving rise to the claim. For claims related only to free website use, our total liability will not exceed 100 US dollars.
These limitations do not exclude liability that cannot lawfully be excluded or limited. Your rights under applicable consumer-protection law remain available to you.
12. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless The I AM Reset and Audra Miller from third-party claims, damages, and reasonable costs arising from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person's rights. This section does not require you to indemnify anyone for their own unlawful conduct.
13. Governing law and disputes
These Terms are governed by the laws of the State of Ohio and applicable federal law, without regard to conflict-of-law principles. Before filing a formal claim, you and The I AM Reset agree to make a good-faith effort to resolve the issue informally by email. If it cannot be resolved, the parties consent to the jurisdiction of state or federal courts located in Ohio, except where applicable law gives you the right to bring a claim elsewhere.
14. General terms
If a provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer these Terms as part of a business reorganization, sale, or similar transaction.
15. Changes to these Terms
We may update these Terms as our Services or legal obligations change. The updated version will be posted here with a revised effective date. When required, we will provide additional notice. Continued use after an update takes effect means you accept the revised Terms.
